Human Resources Code of Ethics Policy Update - 11/15/05

This product was revised in response to the FDIC's FIL105-2005 "Corporate Codes of Conduct - Guidance On Implementing an Effective Ethics Program" released on 10/24/05. This guidance reminds financial institutions of the importance of written standards to promote honest and ethical conduct, compliance with applicable rules and regulations, and accountability in adhering to a corporate code of conduct or ethics policy.

What's Revised

Topic 2 - General Policies. The "General" subtopic section was expanded to include additional basic code of conduct standards.

A reference was made that officers and employees must sign a "Human Resources Code of Ethics Compliance Certificate" (included with the purchase of this product) as a condition of employment.

The "Employee and Contractor Background Check Requirements" subtopic was added to briefly address this subject and make reference to a financial institution's Human Resources General Policy (this subject is covered in detail as Topic 3 "Criminal Background Check Procedures" in our Human Resources Policy Template Product).

Topic 3 - Responsibility as an Investor-Owned Corporation. The "Integrity of Accounting and Records" subtopic was revised to add a few additional sentences based upon the new guidance.

Topic 4 - Personal Conduct. The "Self Dealing" subtopic was expanded to include addition restrictions and a reference to the Federal Bank Bribery Law.

Topic 6 - Confidential Information. The "Protecting Bank Information" subtopic was revised to specifically refer to the adherence of the Gramm-Leach-Bliley Act (GLBA), in addition to a financial institution's Regulation P and Information Systems Security Policies.

Topic 8 - Obeying Laws and Regulations. This "General" subtopic was revised to specifically reference adherence to the various applicable regulations that relate to a financial institution's Code of Ethics Policy.

What's New

Topic 19 - Audit Policy. A financial institution's requirement to monitor its internal controls against self serving practices and conflicts of interest was added.

Topic 20 - Staff Training. A financial institution's requirement to periodically train its personnel on the directives of its Code of Ethics Policy was added.

Topic 21 - Retention of Documents. A financial institution's code of ethics document retention requirement statement was added.
